Man City FFP: PL blow as legal experts reveal likely sanction date while hearing ‘paused’

    Richard Masters on Man City

The hearing into Manchester City’s 115 alleged breaches of profit and sustainability rules (PSR) has been paused in what could amount to a ‘huge headache’ for the Premier League.

An independent commission hearing to examine 115 charges laid by the Premier League against Man City started in September.

The Premier League opened an investigation into City way back in 2018 and after a number of legal delays, charges were finally laid in February 2023 and the club were referred to an independent commission.

The charges against the Citizens relate to the requirement to accurately report financial information, including around the value of sponsorship deals, the submission of details of manager and player pay information and to a club’s responsibility as a Premier League member to adhere to financial fair play rules.

The hearing is nearing its end, but it’s now claimed by The Times that the case will not be concluded before the end of the season, ‘creating a huge potential headache for the Premier League if sanctions are imposed which would have an impact on other clubs’.

Manchester City and the Premier League are currently preparing their closing arguments, but those aren’t due for a couple of weeks and then we will likely have to wait months for a judgement and several more months should either party appeal.

    The report adds:

‘The Lawyer website has reported that the hearing at the International Dispute Resolution Centre in London has been paused while the two parties — City and the Premier League — prepare their closing arguments. These are not due to start until early to mid-December and it could be three months or more before the three-man commission issues a judgment.

‘If City or the Premier League were to challenge that judgment via an appeal that would probably take several more months.

‘One complex financial case heard by the High Court last year had a 13-week hearing, similar to the length of City’s, but a judgment has still not been issued a year later. Other less complex cases can take a much shorter time, but legal experts say it is impossible to predict how long City’s will take.’

Former Everton CEO Keith Wyness claimed the appeal process after the verdict of Man City’s case could drag on until 2026.

Wyness told Football Insider: “Once the deliberations have been made public, and I imagine there will be a three or four-hundred-page document, there will likely be an appeal.

“There could also be a settlement, it all depends on the verdict reached. And I’m hoping common sense can prevail and that settlement can be reached to put an end to this.

“But if there is an appeal, it will go on just that much longer. We could be talking about the end of 2025 or even 2026. Let’s just wait and see how we go with the initial verdict and see if cool heads can prevail.”

"Schemes" (Radio Liberty) referred to officials who agreed on a large-scale alienation of military property of the Armed Forces of Ukraine in 2011, as a result of which the last two Tu-95MS strategic bombers were sold.

In particular, this is Viktor Baloha, who is now the current MP and current member of the commission on legal reform under the president of Ukraine Inna Yemelyanova, reports UNN.

    Details

These are, in particular, the then officials – minister of emergency situations Viktor Baloga-now a people's deputy of Ukraine, First Deputy Minister of Justice Inna Yemelyanova – now a member of the commission on legal reform under the president of Ukraine, and head of the commission on reorganization of the Ministry of Economy Valery Muntiyan – a current employee of the state financial institution of the Russian Federation "Vnesheconombank"

    – the message says.

The journalists also added to the list of Ukrainian officials who in 1999 supported the decision to transfer eleven Tu-95MS and Tu-160 bombers to Russia in exchange for paying off the gas debt, and which are now used by the Russian army.

The journalists found in the State Archive a draft order "on approval of the list of military property of the Armed Forces that can be alienated", which included, in particular, MiG-29, Su-24 and Su-25 fighters, Mi-8 helicopters, Acacia and Gvozdika howitzers, hundreds of T-80, T-72 and T-64 tanks. including the last two Ukrainian Tu – 95MS.

It is reported that this draft was submitted to the Cabinet of ministers in the summer of 2011 by the then Defense Minister Mikhail Yezhel. In the explanatory note, he noted:"the Order provides for granting permission to the Ministry of defense of Ukraine to organize the alienation of the specified military property, which is released in connection with the reform and reduction of military units, institutions and institutions of the Armed Forces of Ukraine in the period up to 31.12.13.

The then Acting Minister of Justice Inna Yemelyanova signed the conclusion of the Ministry of Justice to the draft order with a note – "no corruption-causing factors were identified." When asked by a journalist why she agreed on a project on a large-scale sale of military equipment, Yemelyanova only noted that "all the answers to these questions were provided where they should be provided, and everything has already been investigated by law enforcement agencies.

As previously told "schemes", in November 2013, on the eve of stopping European integration, First Deputy Minister of Justice Yemelyanova was part of a delegation headed by Prime Minister Mykola Azarov to St. Petersburg.

In 2014, she was on the lists on the website of the Cabinet of ministers among those who should have been dismissed as part of the implementation of the law "on the purification of power". In 2019, by decree of Volodymyr Zelensky, she became a member of the commission on legal reform under the president of Ukraine.

The Ministry of Economy approved the sale of military property in 2011 by Valery Muntiyan, then acting chairman of the reorganization Commission. As "schemes" found out, Muntiyan received a Russian passport in 2015. In particular, with the help of the website of the tax service of the Russian Federation, it was possible to establish an individual tax number linked to his passport of a citizen of the Russian Federation. After the revolution of dignity, Muntiyan left for Russia and became an employee of the state financial institution of the Russian Federation Vnesheconombank.

He remained a member of the Academy of Sciences of Ukraine until April 2024. schemes reached out to Muntiyan for comment, but he did not want to speak. He only briefly answered the question of whether he is currently working for the Russian authorities: "no.

The final decision on permission to sell the aircraft was voted at a meeting of the Government of Mykola Azarov in August 2011, the investigation says. Thanks to the above-mentioned order on the alienation of military property of the Armed Forces of Ukraine, the state enterprise "Spetstechnoexport", subordinate to the Ministry of Defense headed by Pavel Lebedev, in 2013 sold the last two Ukrainian Tu-95MS bombers to a private company for 250 thousand dollars.

Subsequently, in 2014, one of the planes was put up for sale on eBay for 3 3 million, but after publicity in the media, the ad disappeared.

It is noted that in 2015, the state Bureau of Investigation launched an investigation into abuse of office when including, in particular, bombers in the list of property for sale.

In the process, the investigation found out that the TU-95MS engines were dismantled "for the purpose of their further sale and illegal export to the Russian Federation", they were intended "for installation on military aircraft of the Russian Air Force". According to the judicial register, the owner of the engines is the company "Dneprobusinessbud".

Co-owner of the company Anna Shafranskaya said that Dneprobusinessbud received aircraft engines on account of debts from the first buyer of aircraft. According to Shafranskaya, law enforcement officers seized their engines back in 2015 and have not yet returned them, "these circumstances led to losses and, as a result, bankruptcy.

When asked about the possible purpose of engines for Russian aircraft, Shafranskaya did not directly answer. There are no verdicts in the case yet, as the prosecutor general's Office told reporters, it was stopped due to the search for the suspect. According to journalists, we are talking about ex-minister Mikhail Yezhel, who has been living in Belarus since 2014.

Ermak named the starting point for the start of negotiations with the Russian Federation

The head of the OP stated that negotiations are possible when returning to the situation on February 23, 2022. Russia has sent 11,000 North Korean troops to the border and continues to escalate the conflict.

The head of the OP, Andrei Ermak, said that fruitful negotiations with Russia are possible only when all the warring parties have a desire to stop hostilities. In addition, the situation must be returned at least to the state of February 23, 2022. He said this in an article for Dagens Industri, reports UNN.

Yermak said that the implementation of the first three points of Zelensky's victory plan, namely: inviting Ukraine to join NATO, increasing military support without restrictions on the use of weapons, and a non-nuclear deterrence package, would put Ukraine in an advantageous negotiating position when participating in negotiations with Russia.

According to him, sending an invitation to Ukraine will not create any obligations for NATO allies under Article 5. However, it will encourage Russia to turn to diplomacy and undermine Putin's intention to continue the war.

"On the other hand, various proposed peace initiatives that entail a ceasefire without any ironclad security guarantees for Ukraine may prompt Russia to launch another full-scale invasion in the near future. Fruitful negotiations are possible only when all the warring parties have the desire to cease hostilities. In addition, the situation must be returned at least to the state of February 23, 2022. This would be the starting point for further settlement, since before that date part of Ukraine was occupied," Yermak said.

But Ermak notes that Russia shows no signs of such readiness, continuing the escalation.

"Putin has sent 11,000 North Korean troops to the border with Ukraine with the possibility of increasing this number to 100,000. Russia's launch last week of a medium-range hypersonic missile capable of carrying nuclear weapons along the Dnieper, combined with Putin's threats of further strikes, once again demonstrates that Moscow is not interested in peace. Every Russian strike and nuclear threat must be met with unwavering determination. The strengthening of the sanctions regime, combined with the strengthening of Ukraine's military and civilian capabilities, especially our air defense, should follow immediately," Yermak said.

According to him, Ukraine's support in the face of these challenges must be steadfast, durable and long-term.

Lithuania allocates €5 million for solar power plants in Ukraine

The Lithuanian government has allocated €5 million to install solar power plants in Ukraine after Vilnius approved a programme to support the country's energy sector.

Source: Lithuanian public broadcaster LRT, as reported by European Pravda

Details: Rasa Kairienė, head of the Development Cooperation Department at the Lithuanian Foreign Ministry, stated on Wednesday that equipment for solar power plants must be reliable and safeguarded against cyber attacks and, therefore, should be of European production.

"When selecting solar power plants, we have to ensure the reliability of the equipment to be installed and the cyber security aspects so as not to create additional dependencies for Ukraine.

So, during the procurement process, we will try to include this requirement that the equipment needs to be originally from the EU or the European economy," she told Lithuanian ministers on Wednesday.

Lithuania's Foreign Ministry reported that Ukraine's energy capacity has been cut by more than half since Russia's full-scale invasion began in February 2022.

Lithuania's total support for Ukraine will have reached €1.45 billion by the end of this year, the Foreign Ministry said.

    Background:

    • Reports indicated that Germany's Federal Ministry for Economic Affairs and Climate Action was allocating another €65 million to repair Ukraine's energy infrastructure.
    • During her visit to Kyiv on 4 November, German Foreign Minister Annalena Baerbock announced the allocation of €200 million in additional winter aid for Ukraine.

NGO warns that lack of funding threatens critical medical evacuation work in Ukraine

The international humanitarian organization MOAS's front-line medical evacuation operation is "on the verge of extinction" due to a lack of funding, the group said on Nov. 27, appealing to the international community to support their work.

MOAS's team of all-Ukrainian medics has been evacuating and keeping alive critically injured troops during the three years of the full-scale war, with the group saying their work has saved 62,000 lives.

"Now, with funding virtually exhausted, one of Ukraine's most remarkable lifesaving operations is on the verge of extinction," their press release read. The group said that without funding, it can sustain its operations only until the end of 2024.

"MOAS is keeping soldiers alive day in, day out. It's an expensive and challenging business, and we simply can't continue into 2025 without additional funding," Christopher Catrambone, MOAS's founder who has been based in Kyiv since the outbreak of the full-scale war, told the Kyiv Independent.

MOAS is now in talks with donors in North America and Europe, as well as the U.K. government, to be able to continue its work next year.

"The facts are simple. If we have to stop our operation, huge numbers of Ukrainian soldiers will die. In the words of a Ukrainian general, it will be a complete catastrophe," Catrambone said separately in the press release.

"They’re overstretched and cannot do what we do. Nor can any other NGO in Ukraine. That’s why today, we are launching this urgent appeal for support. It’s our last throw of the dice, it’s do or die."

According to MOAS, the monthly cost of a 150-strong medical team with 50 "state of the art ambulances" costs $1 million, comparable to the price tag of a Storm Shadow missile.

"We're incredibly grateful to all the donors who have made our lifesaving operation possible," Catrambone told the Kyiv Independent, explaining that MOAS's donors include wealthy philanthropists, tech billionaires, foundations, and smaller donors.

The founder said he was unsure why the funding was drying up, suggesting that some had found other causes to support or simply lost interest in the war in Ukraine.

"But what I'm focused on is getting donors now so we can continue saving lives at the medical frontline in Ukraine," he stressed.
